Question
I have been living for more than 12 years with a roommate, who is 62 years old. I want him to leave, but he refuses. Is he too old to be evicted? If I decide to move out and he isn’t given a new lease (the current one is in my name only), am I in any way responsible?

“When a tenant takes a roommate, the tenant remains liable for all of the obligations of the tenancy,” said Sherwin Belkin, a Manhattan lawyer who represents landlords.
“The landlord has no legal relationship with the roommate,” Mr. Belkin continued. In effect, he said, the letter writer is the roommate’s landlord. “The writer has the right to terminate the roommate’s tenancy and evict him, unless they have executed some agreement that might prohibit that.”
Mr. Belkin said the age of the roommate did not affect the rights of either the tenant or the roommate.
